Notification of Data Breaches
In accordance with the NDB scheme in Part IIIC of the Privacy Act, Chatter Brand Experience will notify affected individuals and the Commissioner of ‘eligible data breaches’. An eligible data breach occurs when the following criteria are met:
- There is unauthorised access to, or disclosure of personal information held by an entity (or information is lost in circumstances where unauthorised access or disclosure is likely to occur).
- This is likely to result in serious harm to any of the individuals to whom the information relates.
- The entity has been unable to prevent the likely risk of serious harm with remedial action.
Chatter Brand Experience will also conduct an assessment if it is not clear if a suspected data breach meets these criteria. The assessment will determine whether the breach is an ‘eligible data breach’ that triggers notification obligations. The primary purpose of the NDB scheme is to ensure individuals are notified if their personal information is involved in a data breach that is likely to result in serious harm. This has a practical function: once notified about a data breach, individuals can take steps to reduce their risk of harm. For example, an individual can change passwords to compromised online accounts, and be alert to identity fraud or scams.
Updates to Chatter Brand Experience’s Data Protection Practices for the Internet
The Company will continue to monitor and review its Internet practices. Where a significant revision is required this will be communicated via the Company website and highlighted accordingly.
